This New Law Could Save You Thousands of Dollars!

A new law just got approved which can help you save thousands of dollars in the sale of your property, is called Law 180-2025.
Puerto Rico's Law 180-2025 establishes a tax exemption on capital gains from the sale of a primary residence, provided that requirements are met, such as having occupied it for at least two of the last five years and not having rented it out. This benefits owners who sell after December 31, 2024, although it applies with restrictions to beneficiaries of the former Law 22-2012.
Key Points of Law 180-2025
Capital Gain Exemption: Allows you to be exempt from paying taxes on the gain obtained from the sale of your primary residence in Puerto Rico.
Occupancy Requirement: You must have lived in the property continuously for at least two of the five years prior to the sale.
No Rental: The property must not have been rented during that period.
Application to Heirs: Applies to heirs if the deceased met the occupancy requirements.
Exclusion: Does not benefit those who are already beneficiaries of incentives under the former Law 22-2012 (now part of Law 60).
What does this mean for you?
If you sell your home in Puerto Rico and meet the residency and use criteria, you may not pay capital gains tax, which significantly reduces costs, since the general rate is 10% on capital gains of property sales.
